one of my close friend grew from a regular programmer to the position of VP in the span of last 6 years. he is facing lot of issues with GC.

clearly mirage didn't mean growing to the position of exactly VP. he meant a higher and slightly different position, for example an IT Manager. It is not that uncommon, for a IT Progmr who works in the same company for 5-6 years, offered a Manager position.

desi, this is argument is going nowhere, ur intentions in the beginning are good and i welcome ur critique, but leave it when recepeints aren't taking it. it became argument just for the sake of supporting ur argument.

Sure, he will face lot of difficulties, if his employer failed to file for H1 amendment when his job profile/responsibilities changed. There is a procedure in place whenever for cases when job profile changes. My job profile was changed, but my employer filed for both H1 amendment and new I-140 to reflect new job duties.

When new I-140 is filed in such cases, beneficiary retains his/her priority date.

    Good Luck with your GC.

I need something which removes employer dependency with approved i140 until u file 485.

I hate working at the same employer just becasue my PD is not current. And by the time my PD becomes current, may be employer is not doing good, I am not happy at the job.... and I have to start from PERM again at new employer. Also if employer revokes i140, I loose the PD as well!!

    Hi supers789,

You don't loose your PD if I-140 is revoked. All you need is an approved I-140. USCIS does honor the PD from a revoked I-140. That is what I have heard from various immigration attorneys. The PD is yours to keep. I think USCIS is generous enough to not push a person out of the queue once you have started your GC and progressed until I-140 approval.

I agree, I am definitely breathing from the July'07 filing. Otherwise it would be worse for me and my family to be working for my first GC employer. I am on your side for that.

A general advice don't stress yourself too much about it. It is definitely not good for your health. I use to check the status on my case every single day during my I-140 stage and got stressed out a lot and eventually earned some health problems from which I am slowly recovering. This is just a friendly advice.

    acharaniya/ other members of thread.

I took home loan from SYNDICATE BANK, Hyderabad 3 yrs ago. The rates were reasonable and I'd recommend them, but you have to compromise little on service. You can directly transfer money from US to Syndicate bank.

My question here is I didn't knew that we can save money in the form of tax deductable/excemption here in US on interest paid in India for home loans. Could you please let me know further details? If possible the CPA who you worked/working with for tax returns.

    Your help is greatly appreciated.

    thanks bro

Its shocking!!! They've foolishly approved many 2006 cases and dont tell me it was unpredictable and now ppl with 2003 r still waiting....how logical is this? A bunch of A** H**** working there or what?

I know, this is very illogical. And very upsetting for the people who are waiting for a long long time. Hopefully, we'll see a shine in the clouds this year. A lot of people are aware now and have stood up against the "injustice" since last year, mainly through the efforts of IV.

And I strongly believe that higher is the volume of the prayers, sooner they get answered.

    Guys,
I was very busy till today.
I'll call all the #s tomorrow and let them know how important is the CIR for legal immigration, and how I am not able to buy a house, or start a company, as I have no greencard inspite of waiting for 8-10 years. Not to forget I am from India and it is severely backlogged. Also we have jobs, so we're not taking away anything.

I have to be very brief. So please let me know if I'm missing any impo point.

You morons, You have spent so much time in useless discussions and anti-immigrants are laughing at your foolishness. Its high time your greencards applications get a denial or RFE. You will come crying to IV to save your status. Or else you will be deported. That is all you can do. You guys have got sub labor or faked your resumes and now you want someone to be accountable to you. First learn to be accountable to yourself and your values.
Here is what antis are telling you aholes:

    STFU you freeloaders

just frustered bcoz you are still stuck in Labor while mostly everybody filed their GC right...... I can understand...... but you should channel your frustration in good way.... may be try seeing a shrink...... I will pitch in $1 if you get shrink help......

I think its the right time to get in touch with the USINPAC. Not only USINPAC but all communities who ever have pacts with US government should start getting involved.

Looks like MDix is making fun of EB3-I bcoz current law doesn't allow any spillover for EB3-I category. Damn you MDix.

Law never changed. Its how USCIS interprets it.

It is a good idea, can please register your vote against "simple letter"
In my opinion, we should do this:

Just send two information to USCIS, DOS, President, VP, First Lady and all Congress person of the following:

    1. 1st info should have a photocopy of our degree certificate(s). On the same page, print your expereince in years and total tax paid till date to the US government.

    2. On a fresh page, type in all the H1B/L VISA approval information and type in bold, we were wanted/invited here legally (and admitted via H1/L).
And, mention that our I140 is approved which means the immigration department has validated our eligibility to become PR.
Ask a question (larger font) on the same page, why keep us on limbo?

This would keep the whole thing short and sweet. We are explicitly saying that we are legals. And we were invited here - legally. We are approved by immigration team to be a PR.

If we could send couple of thousands of letters, I am sure it would have impact as much as any other letter we have in mind.

We are not humiliating them, we are just expressing our frustrations but in mass. May be we can say something like, "Legal Techie slaves in the land of liberty" or "Immigration process that enslave Legal Techies". But, we should keep it short.

As always, ignore this idea if you guys dont like it.

I feel like giving up today after I saw a friend of mine leaving to india with a US Citizenship and an overseas citizen of india card.

The irony is he applied two months after me in the same category except his application was from a different state.

Now it makes me think, if I have to go through this process and after 5 years if I end up like my friend, then I might as well do it now...

Just wanted to caution you that, your friend if he dont like his decesion, he can reverse it any time as he has luxuary of citizenship. If you try to foillow in his foot step, you may not have that luxury and also might have to restrart from scratch if you want to reverse your decesion of going back home.

Latest update from shusterman about bridge legislation for schedule A:

Now, Senator Schumer is seeking to attach the Hutchison-Durbin Amendment to a piece of "must pass" legislation in August. For more information about the immigration of nurses and physical therapists, see "Nurse" page at

    http://shusterman.com/toc-rn.html

and "Allied Health Professionals" page at

    http://shusterman.com/toc-ahp.html

Hope they will pass it this time....
    Questions:
When will be the August recess?
Are there any "must pass" bills, good for such an attachment, scheduled in the senate before the August recess?

I checked with NSC today regarding our AP filed on Oct 8th, 2007. I was told that they are processing September 16th right now and it would be few weeks before they get to mine.

    Thanks
