This is commendable and also an interesting development because it means that the pro-immigration community is essentially saying that it is necessary to allow one group to receive an important immigration benefit out of lockstep with comprehensive immigration reform. Hi All,
I was working in one the SWITCH companies before.
They have a standard experience letter which do not include Roles/ Duties n skills mentioned. I'm having a hard time to get the customized letter from them.
Now, my attorney is suggesting me to get it from supervisor/ co-worker.
My ex-manager is ready to give me the letter. He does not work for the same company any more. So, cannot get it on the company letter head.
Can you please suggest in which format should I get the letter from him.
Should it be on his personal letter head ??
Please help me with this as I don't have much time to refile.

You need a visa to enter Canada that can be applied from any Canadian Consulate in the US. Indian nationals in the US without Permanent Residency/Green Card are required to have a valid visa to enter Canada irrespective of their status in the US.

People suggest to work for 6 months...Remember there is no rule to work for 6 months. But just incase if somebody ask at the time of applying for citizenship, you can show that you worked for 6 months.

Can the primary applicant travel on AP while an MTR is filed to appeal the denial for the dependent? NOD was issued as a result of CIS erroneously stating that the non-immigrant status of the dependent lapsed for over 180 days.

I140 is pending, Filed EB2 485 on Jul2nd, no receipt yet, and we don't know when it will come.
My wife's F1 is going to expire on Aug28. I was planning to file COS to H4 for her now. However, today I heard that filing AOS and COS at the same time will be a conflict and one case might get denied.
Should I still go ahead and file her COS now or wait some more time till we get the 485 receipt? The concern I have is that AOS is not a safe status since 140 is still pending now. However we don't want to mess up 485 just because of the COS application.
Can anyone give me some suggestion on this situation? Hope this is the right place to post the question.

Here is my scenario;
My ex employer (ABC) applied for my green card in 2006. In 2007, I got my 140 approved and I applied for 485. In 2009, I changed jobs using my EAD. ABC still holds my H-1b. Also, I did not file for AC21 yet.
ABC still owes me close to 25k in back pay. I want to report them to Dept of labor and get my money back. What are my options and what are the ramifications of doing so on my green card process?
Questions
If ABC revoked my 140, what should I do? Can I still renew my EAD and AP and continue with my employment in US? My current company is a fortune 20 company and they will support me with any documentation needed?
Since, ABC still holds my h1b, aren't they liable to pay me till date?

I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. Thanks as always...

I am in a situation where I changed my Job and new organization has filed the Visa Transfer process on 28 May 2010.
My and my dependents current H1-B / H4 and I-94 from the prior organization is expiring on March 14 2011 and the H1-B Transfer process has not been completed and rather it is now in the RFE Status as of Today i.e March - 7 2011.
Am I still eligible to stay in US or not. What should be my next course of action.
Please suggest at the earliest.

hey everyone I was trying to download the swift 3d because a pparently it sweems like a cool one but the download trial wasn't accuriable anyway I looged into the net store and checked the full program, it costs about 159$ so I guess I want to download the trial first to give it a try before spending that much amount of money so if any of you know where to donwlaod it just plz post me a message with the title"FOund what you wanted" on your subjectt space.=)

I-140 processing date isn't country specific, but make sure check the date for the center you have applied to - the date varies by center

My H1 with Employer A expires Dec 2009 (7th yr). By that time, if my I140 gets approved (with Employer A) I will be eligible for 3 year extensions from there on. Employer A is willing to keep the I-140 current even if I leave them. Now my question is,
* If I change to Employer B's H1 prior to I-140 approval with employer A, am I eligible to apply for 3 yr extension when I am with Employer B?
Can I transfer from Employer B back to Employer A (if my priority date for I-485 becomes current) when I am on the 3yr extension?
The reason I ask is, if my Priority date becomes current and apply for the I-485, I do not want to use my EAD card. I want to be on H1 to be on safe side (incase anything happens to I-485)
Any help is greatly appreciated.

I think this should be termed "still bad news for most"
Every with the opening up of priority dates, I would say that only a small minority will get a green card anytime soon!
Back to work for us, the brief vacation was nice :)
Don't forget, CIR took out most of the AC21 provisions...

I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).

You could take a look at Track it. It will give you an idea of Atlanta backlogs . You could have a very good chance at Chicago though . Your friend was one in a million lucky and you could be one too .

it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

I have one 485 filed through EB3 with priority date of June 2004. I have another labor and I140 filed through a differentr employer in March 2005. I140 for that is approved. But when I filed the 140 I did not get the priority date transferred to the new I 140. So the second 140 has a PD of March 2005 which is not current. Can I apply a second 485 by porting the PD of my earlier 140 and apply for 485 now? What document do I need to submit for porting the PD?
