I initially voted in favour of this, but on further reflection, I think this is bad policy and urge others to not support this.
Giving I-485 benefits to people without current PDs is a bad idea. It creates a class of immigrants who are neither non-immigrant visa holders (h1b) nor are they lawful permanent residents (i-551) with a set of rights that falls into neither category. The AoS pending status is intended as a short-duration temporary "gap" coverage for people who are a matter of months from having actual I-551 rights.
Essentially, this proposal aims to make every month into the July 2007 fiasco. In addition, and this is the truly horrible part of it, relieves US employers of the pressure and costs they feel now, extending H1Bs every 3 years. That means that the only allies that legal EB immigrants have (US Employers who require their services) are detached from the immigrants themselves...they no longer have a dog in the hunt, and will stop whatever pressure they are bringing to bear now upon Congresscritters and Senators to increase the number of EB visas available.
Disconnecting the interests of foreign-national employees from their US employers will weaken the political position of the foreign-national employees. We cannot vote or contribute to campaigns, our employers however, can do both. If employees are shifted to EADs and APs, with no further involvement of employers in their immigration status needed, then those employers become disconnected from the process, and the one and only ally the legal immigrant has is no longer interested. That's a horrible thing for the immigrant to advocate.
I strongly urge IV to back away from this proposal, as it is not in the long-term interests of the EB Immigrant community. I urge IV to instead focus their resources on items that will help immigrants long term, like increasing the number of EB visas available through initiatives like eliminating the DV program and allocating the visas to EB applicants.

I've just received an RFE for my I-485. I am feeling incredibly disheartened because I thought I'd done everything right and I am struggling not being able to work or travel... I have a seriously ill family member back home, and my husband and I have an understanding that if anything happens I'm getting on the plane no matter what. I'm just praying I get my AP soon so the "no matter what" doesn't have to mean abandoning our home and life here in the US.

Guys,
Here how it goes, one of my friends visa date got current in June 2007. He applied for his I-140 and I-485. For some strange and unknown reason to me , he did not file I-485 for his wife who is on H4 and thought that he will file later once he gets his receipt. Now he has his receipt and was getting ready to file the i-485 for his wife it dawned on him that dates are retrogressed again and the lawyer told him that he cannot file I-485 for his wife. Now the situation is that he has to wait until the dates get current, but what if they dont and he gets his green and his wife dont which will automatically make his wife out of status and she has to go back and you all know how hard it is to sponsor on green card.
My question is that, is this the true statement that he cannot file I-485 for his wife due to retrogression since his wife is dependent and should be able to file since his dates were current?
If this statement is true what are the available options

The Government Accountability Office has released a new report studying the accuracy of the E-Verify database. According to the report, the number of tentative non-confirmations has decreased by 5% over the last two years, an indicator that the system has more complete records than in the past. The report also praised USCIS for instituting new measures to protect the privacy of employees and improve oversight of employers proper use of the system. Hello,
Here is my situation :
1) Labor filed in EB3 in June 2004. The labor was filed in non-PERM and approved. I-140 was filed in Aug 2007 and it is approved in Dec 2008 with Priority date of June 2004
2) Labor filed in EB3 with same company in May 2006 through PERM. Got approved in 2 months and I-140 applied and approved within 12 months in April 2007. Priority date is May 2006. Applied for 485 in Aug 2007 and have EAD/AP based on it.
I am no longer with the company (quit after 180 days after 485 was applied) and am working for another company on H1B using AC21.
Question is, can I port priority date for 485 processing from May 2006 to June 2004 in my case where I have changed employer. Note that by time June 2004 I-140 is approved, I am no longer with that company.

Dear All,
I am sorry for posting this message on the Immigration group because it doesnt really relate to the immigration issues. I have been a part of this group for a long time, and hence I thought of sharing this with you all. Although we all are here in the US, we all have our families and friends back home in India. I am sorry for posting this message on the Immigration group because it doesnt really relate to the immigration issues. I have been a part of this group for a long time, and hence I thought of sharing this with you all. Although we all are here in the US, we all have our families and friends back home in India. No, salary.com is not the right source, infact it may be higher too. Flcdatacenter is the correct one for prevailing wage.
