Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
Does someone has answer for this?
If your job profile demands seniority (which it must be - going by your EB3-2003 PD), you are better off refiling under EB2, instead of *just* (read just) spending couple of thousands on IV campaigns and beating up on people who are not contributing as much you have done to IV. That is not to say we stop contributing for the general cause. Don't misunderstand and start flaming at me, won't do any good.
I have not done this myself with the same employer, I changed my employer for a senior job position and I had also acquired a masters degree in comp engg from a reputed university before I became eligibile for EB2. But as a fellow IVian, who understands the EB3-I issue, I would surely advocate this not only to you but to all other EB3's with older PDs.

I wish there was a better way to establish priority date other than an approved I-140. Anyways...

I have one question regarding your view. Actually point system gives points to the US experience and employer sponsorship. Because of limited number of greencards Those who are not having both of this may not be able to get green card. If you give your calculation everyone will get clear about. I think MS with 5 year US experience will get more points than fresh Phd. That serves the purpose. If that is the case then only eligible people will get gc.

The option to file 485 after labor approval before priority dates become current is not present. It is not present in specter's bill either. It was present in S.1932 but current bills do not have that provision. I hope someone brings in an amendment to include this feature. This would help greatly for most of us.

I am in EB2 ADP with PD Feb'09. No cheating there ! :)
I understand that if a lot of EB3 guys, who have been waiting for years, start porting to EB2, they will end up in the queue before me :(. And with that knowledge, I will still support EB3-EB2 porting.
EB3 guys, porting is your best option. I hear a lot of EB2 asking you to go get a new job where they are willing to
a. Hire you with your H1B status,
b. Agree to file your GC, and
c. Agree to do it in EB2 category. (Think about the min wage they have to give and prove etc.)
It is way easier said than done in the current economy. But if you find one, go for it. That is a way of respite for you folks. For others, try porting to EB2 with your current company.
There have been cases where EB3 was filed when the candidate was eligible for EB2 and there have been cases other way round too. But talking about none of them helps your cause. Similarly, fighting amongst us doesn't help either. Don't get me wrong if I say that with EB2 movement, if EB2 becomes current by the end of next year, EB3 will start seeing a good benefit of spill overs. So with current laws, getting EB2 out of the way will actually help your cause
Eliminating per country limit will help everyone. We should fight for that, EB3 and EB2 together.
Seriously try for porting. I have been waiting just a year, and already know how many decisions get put on hold because of this process.

Looking back, do you think it was worth making the job move using AC21? Is it really worth the time, money, anxiety, sleepless nights that you go through during NOID-MTR?
For people getting layed off, they have no choice but to use AC21, but for rest of us, why not continue with the job you are currently in and let the GC take its turn rather than risking it?

Well - depends on how you perceive it. A few days of anxiety is better than working with same salary/same job for years? Most of my friends are scared to use AC21. They are just shit scared, they do not want ANYTHING to happen to their Green Card - they did not join IV because they are scared that something will happen to their GC petition.
Knowledge is power, ignorance is bliss. I used AC21 because I was with desi employer - though our relationships were good, as the client filed for chapter 11, my desi employer who has a poor accounting system figured out that there were a lot of invoices unpaid which he never bothered to follow up and lost a lot of money and rubbed everything on me. So it was a good time for me to get out of such mess as I already finished 180 days after filing 485 and as such I had been doing my own marketing, negotiating my own billing rate, and always billable so I utilized this opportunity to get into a more stable job which is decent paying.
I talked to various lawyers and was aware that AC21 has some risks involved but everything can be sorted out. I weighed options, though I could stay with the company, I moved on.
So it is your choice.

If you pay a closer attention, I don't start threads. I just reply to messages following that topics you started. The real issue is that many members in this forum are so biased that you cannot take a different view.
For example, yesterday many in this noble forum became so uneasy and angry as soon as I mentioned that shift from democrats to republicans was triggered solely by the disatisfaction with the Iraq war. It turned out that Bil O'Reilly last night said the same thing. That is based on facts, because exit survey according to O'Reilly, did not indicate that people voted against Republicans due to other issues such as immigration. Then I went on and even showed articles from liberal newspapers such as The Nation to confirm my sources. CNN published e-mails from several voters on why they voted against republicans and immigration was not even mentioned in that sample. If you do not want to believe that and prefer to follow other views, that is fine. My point is, I won't get mad with you. I won't request that administrators shut you down. You have the option to do so. However, saying that my analysis is off base and I bring here unrelated topcis is not true. There are reputable people out there who agree with me. Grow up and learn how to deal with the reality.
What amazes me is that those are not fundamental issues for you to discuss and get so mad about. Who cares now on why people voted republicans out? For you and me it matters that we take you greencard and move on. I feel that it is my way to contribute when I admonish you about distorted views. Bringing that level of critical thinking may strength your maturity and knowledge and that can certainly increase your skills in the fight for immigration relief for the employment based immigrants.

That is based on facts, because exit survey according to O'Reilly, did not indicate that people voted against Republicans due to other issues such as immigration. Then I went on and even showed articles from liberal newspapers such as The Nation to confirm my sources. CNN published e-mails from several voters on why they voted against republicans and immigration was not even mentioned in that sample. If you do not want to believe that and prefer to follow other views, that is fine. My point is, I won't get mad with you. I won't request that administrators shut you down. You have the option to do so. However, saying that my analysis is off base and I bring here unrelated topcis is not true. There are reputable people out there who agree with me. Grow up and learn how to deal with the reality.
What amazes me is that those are not fundamental issues for you to discuss and get so mad about. Who cares now on why people voted republicans out? For you and me it matters that we take you greencard and move on. I feel that it is my way to contribute when I admonish you about distorted views. Bringing that level of critical thinking may strength your maturity and knowledge and that can certainly increase your skills in the fight for immigration relief for the employment based immigrants.

Anyways, Any guesses on what the PD will be in Oct VB? My guess is they'll not progress much and will try to stick to the June Bulletine timeframe..
