    It looks like USCIS needs an "official bribe" to provide that information.No body really knows if all the applications filed are really there or they sold it to recycling companies.Send that to Senator and ask him how much would he take to get us that information.If Senator is cheaper than $5000, I would give it to Senator.

    Hi all,
    Sorry to be asking again, but I needed some details on changing employers before Oct 1st.
    Here's the situation. I am currently on H4 and got my H1B approved this year through a consultancy with start date of Oct 1st 2007 (lucky to get through lottery).
    I only have a copy of the H1B approval notice.
    A few days back I got an offer for a full time position with another company (NOT a consultancy). And they are willing to do my H1B.
    I learned through this forum, that applying for a change of employer before Oct 1st with an approved H1B, is like getting a new H1B only i'm already counted against the cap for the fiscal year. And because it's considered "new" paystubs are not required. Hope I've got this much right.

    My questions are:
    1. Are all the documents required the same as when you apply for a new H1B ? Only you also have to add the approved H1B notice?
    2. Is it ok if a COPY of the H1B approval notice is sent? Consultancy had a verbal agreement with me that I should work for a year with them , but I don't think anything is on paper. Also they said they would only give me my H1B approval notice (original) once I was placed on a project with them.
    3. Does the job title have to be the same? Consultancy applied as Programmer Analyst, and the new company needs a Web Programmer/Server Administrator. Would that cause any issues?
    4. The new company plans to do premium processing, so if all goes well, can I start working with them as soon as the receipt notice comes in, or do I have to wait till I have the approval notice in hand?
    5. Can the consultancy cause any problems for me with respect to my H1B? Is there any way they can find out about this and revoke my H1B?

    If anyone has been through this and got their H1B approved with a different employer before the H1B start date, then please post your replies here. What were the hurdles , and what should I be wary of to ensure everything goes smoothly?

    I agree with you. Why are we penalised for being on H4 Visa ?

    Most people on H4 Visas are well educated and would easily be able to contribute to american economy. We are lawabiding and can give so much to american economy. All our talents are wasted and skills are rotting sitting around for the backlog centers to clear the LC's and for retrogression to end.Meanwhile we practically have no life and are completely dependant .

    Immigration Voice should try to include the greviances of H4 spuses into consideration.

    I applied for my AP renewal on June 2nd by mail and the same got delivered on June 8th but no reply as of now. I sent me personal check for 305 USD. Please advice.

    Which center did you apply for.

    In my case, I filed through an attorney with TSC. My papers were Fedexed to reach on 6/2 and my attorney sent me scanned copy of receipt notice on 6/8, not sure when he received the RN's but the Receipt Date / Notice Date in the Recipet Notice is 6/2, If your documents reached on 6/8 which is a Monday, leave it a couple days and followup. You have to leave some time for the actual RN to reach you via USPS as well. The payment was made for my case to the Attorney and they cut a check for USCIS. So I do not know how soon the checks will be encashed. Good luck with your renewal process.

    Advantages of applying AOS when PD is not current
    1. No H1 extension needed (especially these days believe me its a nightmare)
    2. No visa Stamping needed (BIG BIG Night mare)
    3. spouse can work
    4. Dont have to worry about LCA blaw blaw blaw. especially after seeing the recent arrests
    5. during layoff do not have to start GC process (in this case AC21 can be used)
    6. WE CAN CHANGE TO EAD WHEN ANTI IMMIGRANTS CRY ABOUT H1 AND IN THIS ECONOMY DO NOT SURPRISE IF H1 IS COMPLETELY SCRAPPED.
    8. Can do two jobs at a time (in this economy its difficult, but this is possible if you are using EAD)
    9. You can work for TARP Companies (There are about 360 bail out banks... so you can work for any of these banks if using EAD)
    10. BIG ADVANTAGE... IF YOU ARE APPLYING EARLY IT IS VERY MUCH POSSIBLE FOR DHS/CIS TO DO ALL THE BACK GROUND CHECK/NAME CHECK WELL IN ADVANCE. AS AND WHEN A VISA # IS AVAILABLE, IT CAN EASILY BE ASSIGNED TO THE APPLICANT. THIS WAY CIS CAN BE EFFECIENT AND WILL NOT WASTE VISA's

    Again I do support others who say that AC21 job titles clause should be relaxed... All I am saying is one step at a time and more over there is a compaign already in progress.
    ALSO numbers really matter. There are lots and lots of my friends who are using AC21 with out any problem.

    I'm hoping this does come through. This is a great step and I'm surprised that the Secretary brought this up on her own. However, hydboy's point is true. This will be most useful if AC21 is honored by USCIS. Kiran's point about convenience for visa stamping doesn't move me. The biggest advantage of applying for AOS is being able to move jobs after 6months using AC21. Anyway, I guess it all depends on the numbers. How many people have had issues with AC21 versus how many have had no issues with AC21. Also in almost everything in life, the ones with negative experience will be more vocal than the the ones who've had a positive experience.

    Ask yourself a question. If you were running a big business - whom would you prefer -- GC Employees or H1-B Employees.

    What may be good for us may not be good for the other side.

    Well depends on the job I want to get done. New Internatinal graduates come with less salary, more enthusiam, are hardworking and would go out of their way to get some work done.

    In addition to that if I have a constant supply of H1Bs why would I want to spend more money on high salary & more perks if I can train newbies in 6 months.

    I hope this amendment will pass as it was proposed by important senators like, Chairman of Judiciary committee Mr Leahy, Mr Cornyn, Mr Hatch. This alters the equation completely. If it passes, the total EB & Merit based visas are 387,000. The total EB visas as per old system will be 230K.

    Merit based system: 247K (147 for newly created point based +90 K to clear backlogs)
    Employer Sponsored System (as per amendment) = 140K

    Therefore 230K is available as per old EB system. Apart from that, most of the EB1 and EB2 guys and the dependents of EB visa holders will be exempted from numerical limitations. This is the proposal we should support.

    So you mean to say that 230K will be for backlog/year and the people who already filed in the old system will also be exempt from the cap if they belong to certain EB1 and EB2.

    If the above is true then we should be in good shape as % per eb category is increased and masters exempt.

    There is also opposition to consider piecemeal options which treat legal immigration reform separately.

    I am generally a very optimistic person but not seeing whats really viable this year.

    I understand that IV is looking into other angles as well. Once again not sure.

    Can IV core comment about what our realistic chances are?

    Please dont answer "Join your state chapters". I am already a state chapter member.
    I don't think it's possible to comment on 'realistic' chances...compred to 2008 there will be better rewards for the same amount of effort.

    Because it is a election year people/politicians will focus more on "popular" bills that will draw real voters. Now they are still in 'fund raising' mode and they may have to budge a bit for the corporation monies...

    To be honest with you, No matter what the chances are what the IV core will comment on this issue, it's for us to think whether there is a better option than 'not acting now'?

    I have been laid off yesterday. My employment ends Dec.
    My 180 days expire Jan. My company said they will not revoke the I-140.

    So can anyone explain the steps that needs to be taken by company B after they transfer my h1, for time period Dec thru Jan.

    Can I use ac21 afterwards? and

    Can myself or my wife work on the EAD that will come to our home address?.

    What else needs to be done by company B.

    Will we just get our green card in email.

    If a query comes should I prove that I'm employed with the former company or is it to sufficient to show employment with similar position alone?

    In short if the former company does not revoke I-140 and I take care of the status thru H1b transfer for the 1 month to hit 180 days, will I need to reapply for the GC?

    Please advice to what you think is right based on your best knowledge.

    I guess there is very little follow-up on this issue.

    Even I tried to get an SSN for my spouse (H4) and was turned down... I asked the lady on the counter to give me a denial letter and have it with me. Maybe it will be of some use later in this process.

    And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

    That's ridiculous. Forget abt the 2 year EAD that you didn't get, you also lost 3 months? They probably hired some part time workers for last weekend who might have screwed up. I did some research before and am pretty sure they started issuing documents with a start after expiry of the first one a long time ago. Even on our AP's which were approved, the start date was september 2008. I got them mid -may..
