    Ah, this is getting competitive, is it?
    Who should decide the winner? The grassroot, highly motivated, common IV members or the forum bigwigs like super (delegates) moderators? We will find out on 1st March.

    it got too cold so we had to go home. We got around 19 letters signed yesterday after our So.Cal meetup

    Impossible to catch up with you:)
    But NORCAL did collect 92 over the last weekend. I collected 40 of those (takes me to 197), the reason to mention this is, it is way too easy for anyone to do this, and people better had strong reasons to not do it!

    Folks this is great news!! I agree, we are all winners in the end!!! :) But don't go trying to beat me now abhijitp haha just kidding :D

    It's the weekend folks, let's print out some template letters and ask friends for 1 minute of their time.

    Let's keep up the momentum, March 1st will be here before we know it.

    Can someone tell me , about the INFO pass process. How does one create a INFO Pass appointment, what is the process , in case i want to know about the status of my 485 application. How soon do u get the appointment ? I am based out of Southern CA

    I guess the cat is out of the bag. Yes, I got my greencard a few weeks ago. Yes, my PD is early 2004.

    There are 2 current theories why:-
    1. I'm very vocal in the media and lawmakers about the problem, and something made this happen (as my co-workers say "they gave it to you to shut you up")
    2. I was a lucky one that was assigned a visa number in early June (when I applied for AOS) - it was approved when my PD was not current.

    I'm not going anywhere, nothing has changed with the current policy. It is still broken. If for no other reason, the bizarre circumstances around my GC highlight more unpredictability and uncertainty in the whole process. I hadn't mentioned it before since it really isn't a big deal in the big picture.

    Congrats.. and good to know that inspite of getting GC you have decided to stick with non-GC holders like us...

    Is there anyway we could go about pushing our story in the media? I am sure all of us combined have a a few thousand bachelor's, master's and ph.d. degrees. We are a group of people with highly advanced skill sets and this needs to be advertised. Maybe convincing a few journalists to take up our cause could be an option. Local newspapers, political blogs, radio stations etc. etc.

    IV has been doing this already! Please join your state chapter, and help continue doing it. Thanks!

    Visiting IV webiste after long time, (yes I got my GC :) ), feel nothing has changed, another flaming post from logiclife and he hopes it will touch egos of those ( as he calls them cowards), but my friend their skin so thick they won't even feel it,

    I have been in this position, when I tried to start state chapter, I was not able to find single person, At that time I had EAD and sucessfully changed jobs, I knew many friends who were still in H1B and crib on every time how they have been exploited,

    Anyway one thing comes to my mind, it still amazes how Mahatma Gandhi was able to inspire people out of this lot to do what they did

    I am willing to do it. I did call up the local senators and congresspeople about supporting the bills. I have asked the GM of my company to give me some political contacts (am still waiting on him) since he had recently gone to DC to do some lobbying for small businesses. Let me check in the DC/MD forum and figure out who we should target/meet.

    sometimes i see that no one will get a GC for 10 yrs..sometimes these calculations make me want to dream of getting a GC that too in next two years..i never noticed that i am over 30 now...thanks to immigration issues..:)

    All,
    I was laid off and since then I have been receiving my unemploment insurance from state of texas. I have my EAD and have been actively looking for a job. Now there is a family emergency and I have to go to india. Is it legal to claim my employment insurance from india? Will there be any problem if I claim my benefits from india?

    I have had good experience with Wayne Chapple Law Firm in Hartford CT. I am dealing with Attorney Taras, and he has been extremely prompt and has responded to all my queries/ update request in a very timely fashion, despite the fact that my employer paid for all the processes. They have handled my case from H1 to GC...I would definitely recommend him!

    One way is to invest regularly in 401 K. By that way you let your investments grow tax free and if you have to or go back to India then you can withdraw them next year, TAX free or less tax. Thus you actually pay less tax and ultimately you might pay lesser tax than your social security. Who cares if the social security is being taken from me.

    I thought IRS will allow you to withdraw your 401(K) with a 10% fine + all applicable taxes. Not sure how that will benefit someone who is forced to withdraw becuase he has to return to India.

    The basic idea behind this approach is to channel all the negative energy into something positive.
    Here is what me and my wife are doing. When the retrogression first hit us in 2005 January we were both devastated even more so because one my friend and his wife, with same the same priority date as ours and similar EB3 RIR got the Green Card on 24 Dec 2004. We would not have been so frustrated if they had the priority date even a month or so before us. But some are just lucky I guess. Coming back to what we are doing. My wife started her masters and finished in May this year. She could have finished in December but we were really banking on the CIR in May so she took more courses and finished it faster. Well that did not happen so whats next. So now I will be starting school again for second Masters this time MBA from one of the top10 B schools in January 2007. Ideally I wanted to do Full Time because its shorter duration as compared to part time but GC God (I wish there was one like that so that I can do the "Nariyal Pooja" or "Mundan" or "Abhishek") had otherr wishes so I have now switched from full time to part time. Lets see if my part time MBA of 4 years wins the race or Green Card wins the racce against time.
    Moral of the story. Channelize your energy into something positive and get masters or second for that matter, or learn a new language, enroll in classes to learn languages that run for 6 months at community classees by the time you get your GC you will know atleast a dozen languages.

    I know these are good ways to keep our mind off the gc, but for most of us who have spent 9 -10 years waiting and have family responsibilities, the steam of further studies has ran out especially if you have to pay for it yourself.

    I know everything, i have been following these forums from past 3 yrs, but i responded to the post by ksircar, he said "I think some SELFISH people with recent PDs are scared as people with older PDs may take the quota" which was inappropriate, cursing core members or people who are eligible to file 485 doesn't help right? that's all i want to say.

    Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I dont know why all these mess in DOL, for taking the labor applications and sending ad instructions.

    AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.
    By the way, your Indian lawyer I dont know the name, sued DOL once and lost.

    IV alone did not win the battle alone, it took the concerted efforts of IV and other organizations including AILA and the threat of the AILF lawsuit to get DOS and USCIS to relent and reverse their decision.

    It obvious you misunderstood the purpose of the AILF lawsuit. Why file a lawsuit seeking injunctive relief to allow plaintiffs to file and at the same time demand reimbursement of medical fees and compensation for mental agony (I doubt if there were any plaintiffs put on anti-depressants or therapy in those two weeks as a result of the decision). You can't have your cake and eat it, you either win the case to enable filing, or you sue for damages incurred as a result of the decision but then you have to forget about contesting the ability to file, I'm sure any sane individual will be glad to choose the former and in this case thats what the lawsuit reflects. If you have ever read any class action lawsuit, the lawyers always ask for costs of the suit, this is normal even in non class action lawsuits, the loosing party pays the prevailing party's costs!

    In the prior lawsuit that was lost, it is clear that Rajiv said recently that such cases against the executive branch of government need to filed in other federal court circuits other than the DC one where it is likely they will not be inclined to frown when deciding against the executive. For the record, his lawsuit was not against the DOL.

We must also be sure that the current laws on the books - which require employers to verify immigration papers - are enforced. No one wants to make this task more onerous or burdensome, but if we reduce the demand for labor from illegal immigrants it will lead to fewer people entering this country illegally.

    Agriculture is one of the most important industries in upstate New York . While some farmers can find sufficient labor locally, many can not find the workers who allow them to keep their family farms in business. I do not support cutting off the labor supply to upstate farmers who depend on seasonal workers to run their businesses. America 's farmers should not be punished for government's failure to adequately police our borders and implement a reasonable, transparent guest worker program.

    Congress faces the urgent task of enacting comprehensive reforms that will preserve the traditions that have made this nation great, while addressing the security challenges we face. As debate continues on immigration, please be assured that I will work with my colleagues on both sides of the aisle to reform a broken system in a way that protects families, respects human rights, strengthens our border security, and enforces the laws of our country.

    It�s so easy to say change of leadership....but as a member what you have done till now....


    I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!

    That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.

    I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!

    But I am writing this for the benefit of IV and please take this as constructively as you can. As a member, I have full right to suggest a change of leadership when I think it can help.

    The country cap does make perfect sense for Family Immigration, you want a good mix of culture in the country.
    BUT for Skill based immigration it makes no sense. It should be based on skill/qualification and NOT on country of birth. It is very similar to Indian caste based quota system, your piece of pie calculates right when you were born!

    I do not agree with this country quota and hence $1k for LS from me, Pledged!
    Of course, if successful it may/may not make much difference because of other retrogressed countries with long queue but cause is what makes the call.

    2)
    If a group is thinking about LS for USCIS inefficiencies between 2002-2004 and unused visa recapture, I pledge another $1k for the LS. If I remember correctly, Mark Bartosik was planning for such LS but in middle he got his GC, if someone still thinks along the same line, I would be happy to join.
