I filed for I751 (remove condition of my green card) on June 2007. Received by USCIS on June 07, 2007. I already received my extension and the biometric appointment.... still on Texas center. How long you think I have to wait until I get a response of approval??? they said (before they got behind) that it takes 6 months.... December will be 6 month.... who knows what is really happening on immigration??? what cases they are putting behind and what cases they are working on??? (I know that the time schedule says April 07, but in the last month they only process cases receive on 4 days, last month said April 3 and this month April 7)
The thing is that I want to change my Job, but who will ever hire me with only a 1 year extension green card!!! help please!

Think Progress explores the subject. It notes the Miami Herald's interview of a prominent Miami-Dade Republican. Cuban-Americans make up a critical part of the Republican base in Florida and they are increasingly unhappy with the xenophobia expressed by many in their party. GOP lobbyist and fundraiser Ana Navarro, who dropped her support for McCollum after he proposed a law tougher than the controversial immigration bill in Arizona, said McCollums stance lowered his margin of victory in Miami-Dade and kept many Hispanic voters from going to the polls. I think he can blame [immigration], Navarro said. I think if you...

My spouse is on H4 currently. Have applied for H1 in April 2007 and got the H1 aproved. So the new H1 starts on Oct 2007. However, we applied for 485 and got our EAD's (No recept number, No finger printing etc).
Can my spouse use EAD to start job? we dont want use that new H1 currently. What are the implications if we use EAD? Will the H1 (and my H1) be effected?
Search and you'll find your answer...
Using EAD will invalidate H1/H4 status...
You may file for H1 transfer later to revive your H1 status if needed...

Do you need to submit copies of your approved LC or I-140 to support your stay beyond 6 years? I don't see it mentioned in the I-129 application.
And do you say yes or no to the following question (Q.5, Part C of H-1B Data Collection and Filing Fee Exemption Supplement form)?
"Has the beneficiary of this petition been previously granted status as an H1-B nonimmigrant in the past 6 years and not left the United States for more than one year after attaining such status?"
This probably wishes to know whether you have a reason to stay here for more than 6 years. But I don't see anywhere to explain that. Any help is greatly appreciated.

The USCIS has announced that most employment-based (EB) immigrant petitions (I-140s) will be eligible for premium processing starting June 29, 2009. We link to the USCIS Update from our "Premium Processing" page at http://shusterman.com/toc-premium.html#2 Premium processing will be available for EB-1 Persons of Extraordinary Ability and Outstanding Professors and Researchers; EB-2 petitions which are not for National Interest Waivers; and EB-3 petitions for Professionals, Skilled and Unskilled Workers. The only EB I-140s which are specifically excluded from the program are (1) visa petitions for Multinational Executives and Managers under the EB-1 category and (2) National Interest Waivers under the EB-2...

Marshall Fitz, advocacy director at the American Immigration Lawyers Association's annual meeting in Las Vegas that Democrats could see passing immigration reform as a chance to lock down the allegiance of the surging Hispanic electorate in the coming years. And Republicans who see the dangers of permanently losing millions of voters are more likely to get on board.

They can incorporate a company but they cannot do any work for it( not even write a check) or take any salary from it. But if the person has an EAD, there are very few restrictions.

One of my long-time paralegals at Siskind Susser, PC is Esther Schacther Fridman. Esther, who grew up here in Memphis, is the granddaughter of Holocaust survivors. In 2005, she married Benny Fridman, an Israeli who was on a work visa in Memphis at the time. The two moved to Israel shortly thereafter and Esther continues working with the firm on writing projects. Esther and Benny are the subject of a new documentary which premiered in Memphis last night. The union of Esther and Benny is unusual - their eight grandparents were all Holocaust survivors. I am friends with two of...

Hi All,
Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.
On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?

You should pay taxes in PA.
In case your employer is running the payroll from MI, then file MI taxes as Non resident and PA as resident. You will get credit for paying non resident taxes in MI on PA's state tax form.
Don't pay resident taxes in the state where you are not staying. I got this info from a HR block tax consultant..

1. EAD six months, AP four months
2. SSN can be applied after getting EAD. Some times USCIS database is not updated and so it may take couple of weeks after you apply for getting SSN. Otherwise, it should come in 10 days.

Guys,
My company is forcing everyone to fill I9 form. I have EAD but maintaining H1 status and did not use EAD. I did some research on I9 and it is no where mentioned that only people with EAD has to fill this. I need Guru's opinion on this.
I just don't want to loose my H1 status in any case.

A lot of nice tributes to Senator Kennedy recognizing his immigration achievements. Here are a few: Ted Kennedy's Greatest Accomplishment: He Created Americans - Dana Houle of Daily Kos talks about Kennedy's shepherding through the 1965 Immigration Act. From HIAS. From the National Immigration Forum. From the American Immigration Lawyers Association. From the Immigration Policy Center. From the Migration Policy Institute. Partha Banerjee in the McClatchy News Service And here is a speech Senator Kennedy gave in 2006 promoting his immigration reform bill:

Hello everybody,
I am a new member. I read some of the posts on this website and know that there are some Singaporeans in this thread who have applied for the H1B1 visa under the US-Singapore Free Trade Agreement. Questions:
1. How long does the process of applying for the USSFTA H1-B1 take?
2. Where is the best place to apply for the USSFTA H1-B1 visa?
Please advise especially if you have already done it. I am about to start the process. Any advice is highly appreciated.
Cheers!!

Our son was out of the country when we filed our 485 on July 2nd. Now he returned to US, how shall we file his AOS? Form I-485 or anything else? Shall we include a copy of our filing inside?
In addition, the I140 was approved after we filed. And the principal applicant went out of the country and applied H1 visas and returned also.
Shall we include the updated information of the principal inside or just the copy of the original filing?
A million thanks!

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).
Thanks
