    Hello

    My friend is in a wierd situation.

    His employer applied for H1b under premium processing in USA, the application was sent back as some information was missing under 221g. The employer has submitted the application again. Does anybody know how long will it take for the application to be processes as it was initially filed under premium processing?

    Also, since now the H1b approval is not confirmed, He is under OPT and it expires in Aug 2011. Can he apply for STEM extention as his employer is e verified. so incase his h1b is not approved he can still continue to work under OPT. Is it possible to get the STEM extention while his H1b is still under processing? Need you urgent advise. Please help!!

    Both my wife and I are working on H1B visa.

    We are landing in Canada for H1B visa renewal.

    However, the nvars.com appointment system allows 1 primary applicatnt and then allows to add dependents to that application. Should I add my wife as a dependent or create an independent primary applicant profile for her since she would be requesting an H1 B renewal as well.


    If I create an independent primary applicant profile for her, I may not be able to get the same visa date / appointment for both of us.

    Please guide.

    I had applied on July 19th to Nebraska. My I-140 was approved from TX.
    Today I received transfer notice WAC...., mentioning that they have transferred my case to TX Service center.

    The receipt date is of Sep 14th, Notice date of Sep 17th'2007.

    Does it mean I lost the original filing receipt date of July 20th'2007.

    It's true that Obama is focusing on the economy now, but if we do a massive flower campaign now it will get us press and attention and "loosen" things up, then we can go for a second even bigger flower campaign in the spring and in the summer when the previous flower campaign will still be alive in the public's memory. That way people will say "wait, legals? that's different than illegals, and it sounds serious"

    We need to get ourselves noticed! The illegals had Obama on the Hispanic radio show with "Piolin Sotelo" last week. Why aren't we doing anything? We are not cowards, are we? The illegals can but we legals can't?

    Let's not stop with the flowers until we're heard. We send this week, then in a couple of months and so forth until they fix the injustice we're in

    I'll send the first bouquet of flowers to USCIS or DOL or the WHite House if I can get 10 volunteers to send with me. Who's with me? Let's send them this week. Who's in?

    my first PWD was submitted on feb 8 and it came back apr 8. the wage was too high. so a new pwd was submitted on apr 16. it came back today with a proper wage.

    My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.

    Can I work part time on EAD, while I-485 is pending, without loosing my status? What could be potential issues?

    I want to go back to school and complete a master's degree.

    Hi All,
    I just called USCIS using the POJ method to check on my I485 status which is current for June (EB2 India PD is 3/20/04).
    IO said a visa needs to be ordered for the file and it will be done in the next quarter i.e, July 08.She also said the file will not be assigned to the IO unless the visa is ordered??
    Does this mean that all the visas for EB2 have been used for this quarter? Also, not sure why the file wont be worked on until the visa is ordered...which contradicts the pre-adjudication theory.

    Given the uncertainity of getting green cards and the possibility of having to move back to India with your US born kids I would like to seek opinions on what IV members think is a relistic timeframe for kids born and raise in US to be able to tranfer to schools in India and still able to adjust/cope.
    I am refering to regular SSC/ICSE/CBSE school in India (not IB or International schools). I am sure that the workload and requirements of the Indian schools is much rigorous then public school in US.

    Greetings,

    First time poster, long time reader.

    I recently received a RFE on my I-140 application for special registration (only apply for men born in the middle east). My attorney and I replied to the RFE letter explaining why I did not register for the requirement. It is been three months since they received my letter (as shown on the e-gov website). I still have not heard anything from USCIS. My status still reads 'RFE: Response Review'

    My question is :

    Do they always formally reply back to the applicant's RFE response and indicates whether they accepted it or not.? If so, will it be within the 4 month process time.?


    Aprreciate any thoughts.

    For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications.     HI,

    I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

    It will not be "a problem"; but they will stamp your passport only till the exp date of passport (March 2011) and your I 94 (that you will get upon returning) will also be valid till March 2011 as well.

    I am applying for new H1b in April. Also I have 485 applied under EB2 with I-140 approved.

    1. Can anyone tell me what all information about my green card status I need to share with prospective employer attorney to make sure they provide it in H1b application...???

    2. What's alien number and where can I find it...???

    Guys..
    I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. Thanks as always...
