I would like to clarify - anything beyond 0 minutes late is rude. I have a management position in my job, and if that happens at a meeting i'd set up professionally, they get a verbal lashing from yours truly.

Unless you have some disorder which prevents you from looking beyond 2/3/4 years, you REALLY should be joining hands with IV so that we all are "free" at the end of those 2/3/4 years!
If you just can't spend any time volunteering, then at least don't RSVP for such meetings! You know you would be fired if you did this at work.

I think Both Sen.Obama and Sen.McCain are interested in legal Immigration. Mitt Romney was a big Advocate of legal Immigration. But of course, these are not the priority Items for both the candidates and also have to reassure the citizens that they will create new Jobs. Both of their plans will not affect Outsourcing

Problems will not go away. Such incidents may happen elsewhere or in the same place.
If Air France was genuine they should have made everyone stay in the same place or atleast talk to theie department of immigration and arrange a temporary supervised visa and take all people to the hotel.

What if there was a terrorist attack on airport? They will still ask for transit visas for Indians to get outside airport? Best is avoid Europe at all costs and fly direct. Avoid any city in between including middle eastern cities.

Please be considerate to your good employer and good attorney of yours. You do not want to burn bridges, when you leave. Give them at least 2-3 weeks notice. That is the least or at least work with them for 6 months since that is what the law would require you after getting GC.

What are we doing as a group of people? Is it such a wonder that this country isn't moving on our immigration woes when we ourselves won't pick up the phone and talk to somebody about our troubles?
Wow-talk about complete and total apathy....I'm ashamed on behalf of each and every one those people who think they'll let someone else solve their problems - in which case I hope they don't ever complain about their lot in life. They have no right to.

You are certainly entitled to your interpretation and Mr. Gotcher is entitled to his but I wouldn't go as far as calling it a ploy to increase more traffic. I am not sure if you are an attorney but he is and he certainly has more understanding of immigration law than most of us here. As with any law and immigration in particular, there is room left for interpretation and Mr. Gotcher is simply stating his point of view. You are more than welcome to disagree with him but I wouldn't call him greedy.
According to posters on Mr Gotcher's forum, there are law firms that are already preparing class-action lawsuits on behalf of I-485 applicants who claim to have been disadvantaged by the change of interpretation in the April bulletin. I don't see anything wrong with Mr Gotcher discussing the issue to clarify different interpretations, and even determine whether these potential lawsuits have good chances of succeeding. This issue and potential outcomes are equally important to both EB-2 India and EB-3 ROW people.

I am with Company A and my current H1 expires on Nov 2009. I got an offer from Company B and they are insisting to Join with H1B Transfer Receipt ( and not on getting I-797 Approval). Please let me know the following:
1. Can I join Comapny B with H1B transfer Receipt, can Comapany A create any issue here (like if comapany A cancels H1 Visa after I get receipt from Company B)
2. After I join Comapny B with H1B Receipt , and I get 1 payslip from Company B , Can I go to India and Come back to US with Visa Stamped (from Company A) and H1B Transfer Receipt from Company B ( Note I still may not have I-797 Approval Notice)

I dont think this bill has or will have any favorable provisions for us unless a miracle occurs.
I think the tech companies have cut a deal with the Senators through which they will have access to 115,000 H1Bs and more moving forward inlieu of no increase in EB green cards.

I dont think filing EB2 is that easy. First condition is not that candidate likes to be Eb2 that drives the labor application (I wish that was the case then every one would have asked for EB1) it is the job requirement that should be able to qualify for EB2. (for people working in large corporations this will be the stumbling block) for people in consulting business this is not an issue but in this tight market with A2P and wages could spoil the party along with DOL activism for audit does not mean things will be piece of cake. For EB2 from candidates side he/she needs to have MS preferably in same field as work ( So MS Mechanical working as DBA might face RFE to explain) or the previous work experience might be scrtunized more to validate it satisfies the labor requirements.
All Indians and Chinese will file only EB2 now onwards:D

One could just proxy a perl/java gateway and write a script to parse data.

There are issues at government agencies beyond the technical nitty gritty and my post was to point out that the skill set required is not the SQL/CRM of today. Suggestions such as we can offer expertise in return does not go any where as the systems on which the databases reside are not playgrounds, where we can write code and extract what ever we want. There are change control issues, security clearance issues, just to name two on top of my head. The total time for response is not just the time it takes to develop and run a computer program and provide us results. There are administrative issues at different level of abstractions at every org and CIS sure does have a bit more of that. All these consume time. At this point, the NRC response does not indicate time but indicates cost. We are trying to find the total time it takes to send a response back to us. Based on the response time, further action needs to be taken. It is illogical and absurd to just keep thinking technically. Take of your techie hat and think beyond. All comments in jest!
For those who are wondering big time that the country of charge ability/nationality is not captured in CLAIMS, you must have missed that stake holder meeting in which CIS clearly mentioned that it will take lot of $$ to re design their system to capture biographic information and will not be able to do so. Well, what can you say, even after raising the fees by 100% CIS does not have the money to serve beneficiaries who keep filing their flagship cash cow applications such as I-131/I-765. If some one still have the link, please post it.

If an H1 gets layed off, how soon must he leave before he is considered illegal status? And for practical purposes, does it matter (ie, is it ever enforced)? Does having severence extend the period (because you're technically still on payroll)?

I got different explanations on this from different people and this is my understanding after reading different lawyer/employer opinions and after having gone thru one lay-off:
Technically you have to leave immediately. I am not sure if there is a clear law but lawyers suggest that we have to leave as soon as it is practical. INS/USCIS may be lenient if the time gap after job loss is very short (something like couple weeks). Many people quote a 30 day grace period after losing the job and I asked many lawyers � everyone said that there is no 30 grace period but they also told me that USCIS may be lenient if its less than 30 days and if we can give some reasonable explanation (if and when questions arise at the time of later 485 filing/approving). Does it ever enforced � not sure but its better to be on the cautious side. Severence period does not extend the period. The day we stopped going to office (stopped providing service to employer) is our final day.

B1 visa is generally approved if you give the reason of finishing up matters in US (like selling house/cars/closing bank accounts/credit accounts etc).
