Hi guys,
I got as well the unlucky audit like almost 80% of the people filing for a PERM.
My L1 visa is expiring on May 14th and the PERM audit reply was on Jan 28th and based on the current cases pending, I will hearing back from Atlanta sometimes between July-August.
I also applied for the H1-B and get approved but it is starting on Oct-1st,2008
1.- Can I stay "out-of-status" based on the INA 245 that "allow us to stay up to 180 days because change of status in process"?
2.- This changes of status process is valid only when you file the I-485 or for anyone already starting GC process like PERM in process?
3.- If I need to come back to my country and get the H1-B stamped, Do I loose the current PERM even if it get aproved or can I use the same PERM once aproved and apply for I-140/I-1485 concurrently (because EB-2 category) no matter I 'll have a different Visa H1-B instead of L1-B stated in the PERM?

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Harry Reid tweeted today that he'll offer the DREAM Act as a standalone bill which will hopefully help bring along a few of the "procedural" no voters from last September who indicated they like the DREAM Act but didn't believe in tacking it on to a budget bill. I took the HDFC receipt prior to June 28th..and I am planning to go for interview in August..should I take a new HDFC receipt for the difference..?

Yes, this can be done. The H-1 company needs to submit a new I-129 petition requesting a change of status for your brother. Alternatively, your brother can leave the US, apply for an H-1 visa and re-enter in H status.

This story really makes me happy. I just wrapped up a dozen years of service on the board of the Hebrew Immigrant Aid Society, the organization that helped my family and my wife's family immigrate to the US. My LC application (RIR PD Oct 2003) from company A is pending in P-BEC. My RIR got denied recently in Nov 06 and my company informed me that they are considering to use TR->RIR conversion to upgrade the LC to RIR. Can somebody please tell me the process of TR->RIR converion? How long it takes? Pros. and Cons. ?Any help is greatly appreciated
Meanwhile company B filed an LC (RIR PD March 2005). This is also pending in P-BEC. But the lawyer has not received any case number nor 45 day letter.The lawyer is not giving much information. Can somebody please tell me the process?

Hi All,
My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.
Your H1 is NOT subject to cap as you had H1 in last 6 years.
